The CLARITY Act is approaching a make-or-break Senate moment as lawmakers remain divided over political ethics and decentralized finance. Senators Elizabeth Warren and Richard Blumenthal have asked the SEC to investigate President Donald Trump’s $TRUMP memecoin, pointing to an estimated $3.8 billion in investor losses and Trump’s reported $636 million in token-related earnings. The request adds pressure to negotiations over whether senior government officials should be restricted from operating or profiting from crypto projects, even though the SEC has previously indicated that memecoins generally fall outside securities regulation.
At the same time, the crypto industry is pushing back against claims that the bill would create a DeFi money-laundering loophole. The Blockchain Association argues that the legislation appropriately separates developers of neutral, non-custodial software from intermediaries that control customer funds, while preserving existing sanctions and criminal enforcement powers. Senate Majority Leader John Thune has suggested an initial vote could occur before the August 7 recess, but Republicans may need support from roughly 10 Democrats to advance the bill. With the White House yet to approve a stronger ethics compromise and the Senate calendar rapidly closing, America’s long-awaited crypto market structure framework may be running out of block space.
